The Lawsuit: Abuse Committed by Joseph Colin James III (aka "CJ3") and Victor Prentice

Abuse committed by Joseph Colin James III ("CJ3")
(often in concert with Victor Prentice)
against Fr. Tony Begonja and Rev. Mtr. Fran Begonja
since Dec. 10, 1999

Repeatedly shutting down Ind-Movement.org via ISP abuse. Mr. James intimidated and harassed three prior web hosting providers into shutting down this lawful web site: Interland, WebServePro and Web2010/Hostcentric. Mr. James did this by repeatedly telephoning them dozens of times each all hours of the day and night, and by faxing them, emailing them, etc. with bogus legal threats over the pretexts of trademark and copyright violation. He also repeatedly (about 20 times) called one ISP's local police department. At one point, Mr. James reduced the owner of WebServePro to tears. Mr. James conducted much of this activity in concert with Victor Prentice.
Mr. James repeatedly cited the DMCA (Digital Millenium Copyright Act) in an unlawful manner. The DMCA prohibits citation of the DMCA in cases of trademark dispute; furthermore, the DMCA does not prohibit linking and deep-linking.
Mr. James is presently attacking and harassing my current ISP, Computer Tyme, in an attempt to shut Ind-Movement.org down a fourth time.
Telephone harassment. On Dec. 10, 1999, Mr. James placed two dozen expletive-laced calls to both our cell phones in a short period of time. Since then, Mr. James has placed occasional harassing phone calls to my cell phone and/or to me at my secular employment.
Intimidation via a constant barrage of emails, letters and courier-delivered letters containing bogus legal threats. This includes emails to me at my secular employment.
Defamation on the Usenet. This includes dozens of defamatory postings as well as the creation of permanent, defamatory "custom" alt.pedophile Usenet newsgroups for each of us two.
Defamation on the web. From Feb. 2000 until March 2002, Mr. James had posted about a hundred printed pages of defamatory garbage between his own The-Episcopal-Church.org and the now-defunct BeSeen.Com and InternetTrash.com web sites. This is in addition to the dozens of currently/previously posted pages of defamatory garbage on the web sites of Victor Prentice's current OCACNA/THEOCACNA (for which James is a board member, and legally liable for).
Defamation and tortious interference via Spam. Mr. James is a spammer -- he has sent dozens of unsolicited defamatory emails to hundreds of people, both inside and outside of the autocephalous church movement.
Tortious interference with my secular employment. Mr. James conducted this in concert with Victor Prentice -- I have physical documentation to prove it.
Tortious interference with institutional ministry relationships.
Tortious interference with some of our relatives.
Defamation via Denial-of-Service Attack. Mr. James posted approximately 950 printed pages of defamatory and/or garbage on the former guestbook of Ind-Movement.org in an attempt to deny use of that web page. He conducted this in concert with Victor Prentice -- I have the logs to prove it.
Violating our copyrights. Between Feb. 2000 and March 2002, Mr. James committed copyright violations by 1) Reproducing, for a disallowed use, several photographs to which I and/or Rev. Mtr. Fran have copyright to, and 2) Reproducing for a disallowed use, my entire, biographical entry from Ind-Movement.org.
Threatening to shoot me ... twice.
And last, but not least, suing me. Mr. James' lawyer, Glen F. Redmond Gallinger, stated in writing that Mr. James is suing me for the express purpose of costing me dearly in terms of money, time and inconvenience. And, quite obviously, he is conducting *this* activity in lock-step with Victor Prentice.

In short, Mr. James has engaged in a long-term deliberate pattern of abusive and violent harassment and defamation against Rev. Mtr. Fran and myself.
